IMPORTANT NOTICE: PLEASE READ THIS TERMS OF SERVICE AND END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE ACCESSING, DOWNLOADING, INSTALLING, PURCHASING, RUNNING, OR USING ANY SOFTWARE, BOT, API, INFRASTRUCTURE, DIGITAL GOODS, SUBSCRIPTIONS, OR SERVICES PROVIDED BY COSMOS LABS.

THIS IS A LEGAL, BINDING CONTRACT BETWEEN YOU AND COSMOS LABS. BY USING OUR SERVICES, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL TERMS CONTAINED HEREIN. IF YOU DO NOT AGREE, YOU ARE PROHIBITED FROM USING COSMOS LABS PRODUCTS OR SERVICES.

Introduction

This Agreement governs the legal relationship between the digital software brand COSMOS LABS ("we", "us", or "our") and any individual or entity ("User", "you", or "your") who accesses, purchases, downloads, installs, or utilizes software applications, Discord bots, APIs, web dashboards, documentation, assets, and associated digital services offered by Cosmos Labs.

The purpose of this Agreement is to establish the legal framework, rights, obligations, licensing restrictions, liability limitations, and operational boundaries governing your use of Cosmos Labs products and services.

Your relationship with Cosmos Labs is governed exclusively by this Agreement, along with any supplemental guidelines, operational rules, or community standards published by Cosmos Labs across its official distribution channels, Discord servers, web portals, and software documentation.

Acceptance of Terms

By installing, downloading, executing, inviting, configuring, accessing, purchasing, or using any Cosmos Labs Product or Service, you explicitly manifest your assent to be legally bound by this Agreement.

This Agreement applies universally to all Users, including browsing visitors, paying customers, server administrators, Discord community members, API integrators, and automated clients.

If you are entering into this Agreement on behalf of a business entity or organization, you represent and warrant that you possess full legal authority to bind that entity to these Terms.

Any conflicting, supplementary, or alternative terms provided by you or any third party are expressly rejected by Cosmos Labs and shall have no legal force or effect.

Eligibility and Legal Capacity

Access to and use of Cosmos Labs Products and Services is strictly limited to individuals who possess the full legal capacity to enter into binding contracts under applicable law.

By accessing, purchasing, or using Cosmos Labs Products or Services, you explicitly represent and warrant that:

• You are at least fifteen (15) years of age, or the legal minimum age required in your jurisdiction to consent to digital platform usage and software licensing.
• If you are between fifteen (15) and the legal age of majority in your jurisdiction, you have obtained the express permission and supervision of a parent or legal guardian who has reviewed and agreed to this Agreement on your behalf.
• You have not been previously suspended, banned, terminated, or blacklisted from utilizing Cosmos Labs Products or Services.
• You are not located in, under the control of, or a national or resident of any embargoed country or listed on any restricted party list maintained by relevant authorities.

If Cosmos Labs determines that you do not satisfy the eligibility requirements, Cosmos Labs reserves the right to terminate your account, revoke all issued licenses, block your access, and retain any funds paid without refund.

User Responsibilities and Account Security

To access certain features, you may be required to register a User Account, link a valid Discord account, or authenticate through an authorized third-party OAuth provider.

You agree that all information you provide during account registration or license activation is accurate, current, complete, and truthful.

You are solely responsible for maintaining the strict confidentiality and security of your User Account credentials, access tokens, OAuth tokens, authentication secrets, and assigned License Keys.

• You will not disclose, share, publish, lease, sub-license, host, or sell your account password, tokens, or License Keys to any third party.
• You assume total responsibility for all activities that occur under your User Account or through your License Keys.
• You will immediately notify Cosmos Labs support staff if you discover or suspect any unauthorized access to your account or credentials.

User Accounts, subscriptions, API access tokens, and License Keys are strictly personal to the original purchasing or registering User. You are prohibited from transferring, assigning, gifting, swapping, selling, or reselling your account or license entitlements. Any attempt to do so shall render the license null and void without refund.

Acceptable Use and Conduct Policies

You agree to use Cosmos Labs Products and Services strictly in compliance with all applicable local, state, national, and international laws and regulations.

Because Cosmos Labs software often integrates with Third-Party Platforms, you agree to fully comply with all terms of service, developer policies, community guidelines, and operational rules established by such platforms (including Discord's Terms of Service, Developer Terms, and Community Guidelines).

You agree to execute operations responsibly, ethically, and strictly within the technical parameters established by Cosmos Labs. You shall not utilize Cosmos Labs Products to facilitate, encourage, perform, or automate activities that result in resource degradation, system abuse, network denial of service, spamming, harassment, illegal content distribution, or unlawful conduct.

Prohibited Activities and System Integrity

To maintain the operational security, technical integrity, and legal compliance of Cosmos Labs Products, you are strictly prohibited from engaging in any of the actions detailed below. Engaging in any prohibited activity constitutes a material breach of this Agreement and shall result in immediate account termination, license revocation, and potential legal prosecution.

Software Tampering, Reverse Engineering, and Decompilation: You shall not decompile, disassemble, reverse engineer, extract, decrypt, or attempt to derive the source code or underlying structures of any Cosmos Labs Software. You shall not modify, translate, adapt, patch, hook, inject code into, tamper with, or create derivative works based upon any portion of Cosmos Labs Software. You shall not crack, patch, disable, bypass, or circumvent any operational limitations, license validation mechanisms, or security locks implemented within Cosmos Labs Products.

Redistribution, Leaking, and Sharing Restrictions: You shall not sell, re-sell, rent, lease, sub-license, loan, distribute, publish, upload, host, stream, share, or broadcast Cosmos Labs Software, compiled binaries, source code files, digital assets, or License Keys to any third party. You shall not share, leak, expose, or make publicly available any License Key, token, configuration file, or access credential generated by Cosmos Labs Products.

Network Abuse and System Attacks: You are strictly forbidden from executing any action that targets or impacts Cosmos Labs infrastructure, including distributed denial-of-service (DDoS) attacks, packet manipulation, memory exhaustion tactics, or network interception. You shall not utilize Cosmos Labs Products to construct, distribute, or facilitate malware, trojans, ransomware, spyware, or any other malicious payload.

Intellectual Property and Source Code Ownership

All right, title, and interest in and to Cosmos Labs Products, Software, Services, source code, compiled binaries, scripts, algorithms, database architectures, user interface designs, visual assets, documentation, branding, names, logos, and trademarks are the sole and exclusive property of Cosmos Labs.

Nothing in this Agreement shall be construed as granting, transferring, or assigning any title, ownership right, copyright, or intellectual property interest in Cosmos Labs Intellectual Property to you or any third party.

Cosmos Labs Products are protected by international copyright laws, treaties, and national intellectual property statutes. Unauthorized copying, distribution, decompilation, or reverse engineering constitutes intentional copyright infringement. "COSMOS LABS", the Cosmos Labs logo, and product titles are proprietary marks of Cosmos Labs. You are granted no right to utilize Cosmos Labs trademarks without prior written permission.

Software Licensing and Grant of Rights

Subject to your continuous, strict compliance with all terms and conditions contained within this Agreement, and upon full payment of applicable fees, Cosmos Labs grants you a personal, limited, revocable, non-exclusive, non-transferable, non-assignable, and non-sublicensable license to install, execute, and use the specific Cosmos Labs Software or Service for which you have validly acquired a license.

Depending on the specific Product acquired, your license grant shall be governed by one of the following categories:

• Single-User / Personal License: Authorizes a single individual to execute the Software on authorized personal devices or designated personal execution environments solely for private, non-commercial purposes.
• Server / Instance License: Authorizes the deployment of the Software within a designated single server environment, VPS, host machine, or Discord guild as specified during purchase.
• Subscription License: Authorizes temporary, non-exclusive access to hosted Services or Software utilities strictly for the active, fully paid duration of a subscription term.

The license granted hereunder is expressly conditional upon strict adherence to this Agreement. Cosmos Labs reserves the right to revoke, deactivate, suspend, or modify your license at any time if you violate any restriction or term outlined in this Agreement.

Commercial Restrictions and Resale Prohibitions

Unless explicitly authorized in writing by Cosmos Labs administration, all software licenses issued by Cosmos Labs are intended strictly for individual, non-commercial operational use.

You shall not use Cosmos Labs Products or Services to provide paid administration services, resold bot management packages, commercial hosting services, or monetized access to third parties. Any revenue generated through the unauthorized resale, renting, sub-licensing, or commercial hosting of Cosmos Labs Products shall immediately belong to Cosmos Labs, without prejudice to any legal actions Cosmos Labs may take to recover damages.

Privacy, Data Collection, and Technical Diagnostics

Cosmos Labs values user privacy but requires the collection and processing of limited technical data to maintain license validation, prevent fraud, enforce security measures, diagnose system errors, and optimize performance.

By using Cosmos Labs Software or Services, you consent to the automated collection and processing of technical diagnostic telemetry, including:

• Discord user identifiers, server/guild identifiers, and OAuth profile tokens required for account binding and access authorization.
• IP addresses, user-agent strings, system hardware signatures, and machine hardware hashes utilized for hardware-locking, anti-sharing validation, and security auditing.
• Error logs, stack traces, execution counts, crash dumps, and performance statistics necessary for diagnosing bugs and deploying maintenance updates.

Cosmos Labs commits that technical data gathered through product usage will never be intentionally sold, rented, monetized, or shared with unauthorized commercial data brokers. Users may request account profile deletion by contacting support; however, core cryptographic identifiers associated with revoked licenses or anti-cheat flags will be retained indefinitely to protect system integrity.

Third-Party Services and Platform Dependencies

Cosmos Labs operates as an entirely independent software development entity.

COSMOS LABS IS NOT AFFILIATED WITH, ASSOCIATED WITH, AUTHORIZED BY, ENDORSED BY, OR IN ANY WAY OFFICIALLY CONNECTED WITH DISCORD INC., OR ANY OF ITS SUBSIDIARIES OR AFFILIATES. The name "Discord" and related marks are registered trademarks of their respective owners.

Cosmos Labs Products rely heavily on API availability, data structures, network protocols, uptime, and operational policies maintained by Third-Party Platforms. You acknowledge that Cosmos Labs has no control over changes, API updates, feature deprecations, or network downtime instituted by Third-Party Platforms. Cosmos Labs shall bear no liability for any service disruption, feature loss, or account action imposed by Third-Party Platforms.

Service Availability, Maintenance, and Updates

Cosmos Labs Products are provided on a continuous availability effort basis only. COSMOS LABS DOES NOT GUARANTEE UNINTERRUPTED, CONTINUOUS, SECURE, OR ERROR-FREE SERVICE AVAILABILITY.

Cosmos Labs reserves the right to modify, update, pause, restart, suspend, or discontinue any portion of its Software, APIs, databases, or hosted Services at any time, with or without prior notice.

Cosmos Labs may deploy automatic updates or hotfixes to address security vulnerabilities, correct bugs, or adapt to Third-Party Platform API updates. You agree that Cosmos Labs has no obligation to maintain backward compatibility with older software versions or configurations. Cosmos Labs reserves the right to sunset or remove any specific feature at any time without liability or obligation to provide refunds.

Beta Features and Experimental Modules

From time to time, Cosmos Labs may offer access to experimental features, pre-release software modules, or beta testing channels ("Beta Features"). You acknowledge that Beta Features are provided strictly for testing and evaluation purposes and may contain severe software bugs, performance bottlenecks, or stability issues.

Cosmos Labs provides no warranties regarding the stability or functionality of Beta Features. You deploy and test Beta Features entirely at your own risk. Cosmos Labs reserves the right to modify or terminate Beta Features at any time without notice.

Payment Terms, Financial Conditions, and Chargebacks

Access to certain Cosmos Labs Products or Services requires the payment of purchase fees or recurring subscription fees. All prices and billing structures are published on official Cosmos Labs storefronts and are subject to change at any time.

You agree to resolve any billing questions or transaction errors directly with Cosmos Labs customer support before opening any formal payment dispute or chargeback request with your bank or payment processor.

If you initiate an unauthorized chargeback, payment reversal, or fraudulent claim regarding any payment made to Cosmos Labs:

• Your Cosmos Labs User Account, along with all active subscriptions and software licenses, will be immediately and permanently terminated.
• Your account identifiers, IP address, hardware hashes, and payment details will be permanently blacklisted across the Cosmos Labs network.
• Cosmos Labs reserves the full right to report fraudulent chargebacks and dispute activity to risk networks and legal recovery services.

Refund Policy and All Sales Final Mandate

PLEASE READ THIS SECTION WITH EXTREME CARE: ALL PURCHASES, SUBSCRIPTIONS, LICENSE FEES, AND MONETARY TRANSACTIONS COMPLETED WITH COSMOS LABS ARE STRICTLY FINAL, NON-CANCELABLE, AND ABSOLUTELY NON-REFUNDABLE TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

By executing a transaction to acquire any Cosmos Labs Product or Service, you explicitly acknowledge that you forfeit any right to request or receive a financial refund for any reason whatsoever.

NO REFUNDS WILL BE ISSUED under any of the following circumstances:

• Platform or Third-Party Bans: You are banned or suspended from Discord or any other Third-Party Platform as a result of your usage of Cosmos Labs software.
• Account or License Termination: Your Cosmos Labs account or License Key is terminated or revoked due to a violation of this Agreement.
• System Incompatibility or User Error: You experience software incompatibility, hardware insufficiency, or lack of technical skill necessary to operate Cosmos Labs Products.
• Service Shutdown or Modification: Cosmos Labs modifies, suspends, updates, or permanently discontinues a Product, feature, or server infrastructure.
• Change of Mind: You decide you no longer want to utilize the purchased software or service.
• Force Majeure Events: Service availability is interrupted due to natural disasters, internet outages, Third-Party Platform API changes, or unforeseen network disruptions.

Certain jurisdictions may provide non-waivable statutory consumer rights. Nothing in this section is intended to exclude or limit statutory consumer rights that cannot be lawfully waived under applicable local consumer protection legislation.

Warranty Disclaimer

EXPRESS LEGAL DISCLAIMER: COSMOS LABS PRODUCTS, SOFTWARE, SERVICES, APIS, DASHBOARDS, UTILITIES, AND DOCUMENTATION ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS, DEFECTS, ERRORS, AND BUGS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COSMOS LABS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT.
• ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE OF TRADE, OR CUSTOMARY INDUSTRY PRACTICE.
• ANY WARRANTY THAT COSMOS LABS SOFTWARE OR SERVICES WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, OPERATE WITHOUT INTERRUPTION, BE SECURE, OR BE ENTIRELY FREE FROM BUGS OR SOFTWARE ERRORS.
• ANY WARRANTY THAT DEFECTS, GLITCHES, SECURITY VULNERABILITIES, OR PERFORMANCE ISSUES WILL BE CORRECTED.
• ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY DATA OR INFORMATION TRANSMITTED OR PROCESSED BY COSMOS LABS PRODUCTS.

Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE THAT YOUR ACCESS TO, DOWNLOADING OF, INSTALLATION OF, AND USE OF COSMOS LABS PRODUCTS IS CONDUCTED ENTIRELY AT YOUR OWN DISCRETION AND AT YOUR SOLE RISK.

YOU ASSUME FULL RESPONSIBILITY, RISK, AND LIABILITY FOR ALL CONSEQUENCES, DAMAGES, COSTS, LOSSES, AND DISRUPTIONS RESULTING FROM YOUR USE OR INABILITY TO USE COSMOS LABS PRODUCTS.

Without limiting the generality of the foregoing, you explicitly acknowledge and assume all risks related to:

• Account termination, suspensions, sanctions, rate-limiting, or bans executed against your accounts by Discord Inc. or any other Third-Party Platform.
• System crashes, software instability, registry alterations, data loss, operating system corruption, or hardware degradation on devices executing Cosmos Labs software.
• Loss of digital assets, loss of server settings, server corruption, loss of community infrastructure, or operational down-time.
• Security breaches, credential interception, or unauthorized network access resulting from your failure to safeguard your device, access tokens, or License Keys.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COSMOS LABS, ITS DEVELOPERS, OWNERS, OPERATORS, EMPLOYEES, AFFILIATES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR STATUTORY DAMAGES WHATSOEVER.

THIS EXCLUSION OF LIABILITY INCLUDES, WITHOUT LIMITATION, DAMAGES FOR:

• LOSS OF PROFITS, REVENUE, SALES, OR SAVINGS.
• LOSS OF DATA, CODE, CONFIGURATIONS, OR DIGITAL ASSETS.
• LOSS OF GOODWILL, REPUTATION, OR BUSINESS OPPORTUNITY.
• BUSINESS INTERRUPTION, SERVICE DOWNTIME, OR WORK STOPPAGE.
• THIRD-PARTY PLATFORM ACTIONS, INCLUDING DISCORD ACCOUNT BANS OR GUILD DELETIONS.
• COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES.
• PERSONAL INJURY, PROPERTY DAMAGE, OR SYSTEM FAILURE OF ANY KIND.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF COSMOS LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE.

IN THE EVENT THAT COSMOS LABS IS FOUND LIABLE TO YOU UNDER ANY LEGAL THEORY, THE AGGREGATE, TOTAL CUMULATIVE LIABILITY OF COSMOS LABS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL BE STRICTLY LIMITED TO THE TOTAL MONETARY AMOUNT ACTUALLY PAID BY YOU TO COSMOS LABS FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM DURING THE THIRTY (30) DAY PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR TEN UNITED STATES DOLLARS ($10.00 USD), WHICHEVER AMOUNT IS LESSER.

Indemnification

You agree to fully indemnify, defend, protect, release, and hold harmless Cosmos Labs, its core developers, owners, administrators, successors, representatives, agents, service providers, and operators from and against any and all claims, demands, causes of action, liabilities, losses, damages, judgments, settlements, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of, resulting from, or in connection with:

• Your access to, installation of, deployment of, or use of any Cosmos Labs Product or Service.
• Your breach or violation of any provision, term, warranty, restriction, or covenant set forth in this Agreement.
• Your violation of any applicable law, rule, statute, regulation, or third-party right.
• Your misuse of Cosmos Labs software resulting in damage or loss to Third-Party Platforms, servers, or user accounts.
• Any unauthorized distribution, leaking, sharing, or resale of Cosmos Labs License Keys, binaries, or source code originating from your account.

Cosmos Labs reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You shall not settle any claim or dispute that involves or impacts Cosmos Labs without obtaining prior written consent.

Force Majeure

Cosmos Labs shall not be liable or deemed in breach of this Agreement for any failure, delay, disruption, or operational malfunction in its Products, hosted Services, backend APIs, or licensing infrastructure resulting from causes or events beyond its reasonable control.

Such Force Majeure events include, but are not limited to: acts of God, natural disasters, severe weather, fires, floods, explosions, earthquakes; war, hostilities, invasion, acts of terrorism, civil unrest, riots; government actions, trade embargoes, sanctions, legal prohibitions; national or regional grid blackouts, internet backbone failures, major fiber outages, DNS disruptions; widespread DDoS attacks; third-party hosting facility failures; or major non-waivable API disruptions instituted by Third-Party Platforms such as Discord Inc.

Suspension, Termination, and Appeals Protocol

Cosmos Labs reserves the absolute right, in its sole discretion and without prior notice, liability, or obligation to refund, to immediately suspend, restrict, deactivate, or permanently terminate your User Account, active subscriptions, access to hosted Services, and License Keys if:

• You violate or breach any provision, restriction, or policy set forth in this Agreement.
• Cosmos Labs reasonably suspects that you have engaged in reverse engineering, software cracking, unauthorized license sharing, API abuse, or system tampering.
• Cosmos Labs is required to do so by applicable law, court order, or request from law enforcement authorities.
• Cosmos Labs discontinues, sunsets, or permanently closes the specific Product or Service.
• Your account exhibits fraudulent billing activity, unauthorized chargebacks, or transaction disputes.

Upon termination or revocation of your license or account for any reason:

• All license grants, rights of use, and access permissions granted under this Agreement shall immediately cease.
• You must immediately cease all use of Cosmos Labs Software and Services and permanently delete all copies, installer files, binaries, scripts, and documentation in your possession.
• You forfeit all remaining subscription time, account balances, privileges, and access permissions without entitlement to compensation or monetary refund.
• Sections of this Agreement that by their nature are intended to survive termination (including Intellectual Property, Warranty Disclaimer, Assumption of Risk, Limitation of Liability, Indemnification, and Governing Law) shall remain in full force and effect indefinitely.

If your account or license has been suspended or terminated due to a suspected breach of Terms, you may submit an administrative appeal request through Cosmos Labs official support channels (such as our official Discord support ticket system). Submission of an appeal does not guarantee reinstatement or review. Reinstatement decisions are made strictly at the sole discretion of Cosmos Labs administration. Decisions rendered regarding appeals are final and non-reviewable.

Governing Law and Dispute Resolution

This Agreement, its interpretation, performance, enforcement, and all claims, disputes, or causes of action arising out of or in connection with Cosmos Labs Products, Software, or Services shall be governed by and construed in accordance with the laws of the jurisdiction in which Cosmos Labs's principal operations are conducted, without regard to its conflict of law principles.

Before initiating any formal legal claim against Cosmos Labs, you agree to attempt to resolve the dispute informally by delivering written notification to Cosmos Labs support detailing the facts, claims, and specific relief sought. You agree to negotiate in good faith with Cosmos Labs for a period of not less than thirty (30) consecutive calendar days following receipt of such notice before initiating further formal legal action.

IMPORTANT MANDATORY WAIVER: ALL CLAIMS AND DISPUTES ARISING UNDER THIS AGREEMENT MUST BE RESOLVED ON AN INDIVIDUAL BASIS. YOU HEREBY EXPRESSLY WAIVE ANY RIGHT TO INITIATE, JOIN, PARTICIPATE IN, OR PROSECUTE ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST COSMOS LABS. FURTHERMORE, YOU AND COSMOS LABS MUTUALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THIS AGREEMENT.

Severability and Savings Clause

If any provision, clause, restriction, or sentence of this Agreement is determined by a court of competent jurisdiction to be illegal, invalid, void, or unenforceable under applicable law, such invalidity or unenforceability shall not affect or impair the validity or enforceability of any other provision contained in this Agreement.

The remaining provisions of this Agreement shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed modified or replaced by a valid and enforceable provision that comes closest to expressing the original legal and commercial intent of Cosmos Labs.

Entire Agreement and Integration

This Agreement, together with any official operational rules, license keys, subscription confirmations, or operational guidelines published directly by Cosmos Labs, constitutes the complete, final, exclusive, and fully integrated legal agreement between you and Cosmos Labs regarding your access to, licensing of, and use of Cosmos Labs Products, Software, and Services.

This Agreement completely supersedes, replaces, cancels, and extinguishes all prior or contemporaneous oral or written understandings, agreements, proposals, representations, promises, communications, marketing claims, or operational documentation regarding Cosmos Labs Products and Services.

Waiver of Rights

No failure, delay, omission, or relaxation by Cosmos Labs in exercising any right, power, remedy, or privilege under this Agreement shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, remedy, or privilege preclude any other or further exercise thereof.

To be legally binding on Cosmos Labs, any waiver of any term, condition, or breach of this Agreement must be executed in writing and explicitly acknowledged by an authorized core developer of Cosmos Labs.

Modifications and Changes to Terms

Cosmos Labs reserves the exclusive right, in its sole discretion, to revise, update, modify, add, amend, or remove sections of this Agreement at any time to reflect software updates, legal requirements, structural changes, security enhancements, or altered operational policies.

When revisions are made, Cosmos Labs will publish the updated Terms of Service on its official distribution platforms, web interfaces, or designated Discord channels. It is your personal responsibility to review these Terms periodically.

YOUR CONTINUED ACCESS TO, DOWNLOADING OF, INSTALLATION OF, OR USE OF ANY COSMOS LABS PRODUCT, SOFTWARE, OR SERVICE FOLLOWING THE PUBLICATION OF REVISED TERMS OF SERVICE CONSTITUTES YOUR EXPRESS, BINDING, AND UNCONDITIONAL ACCEPTANCE OF THE REVISED AGREEMENT. IF YOU DO NOT AGREE TO ANY MODIFICATION OR REVISION OF THIS AGREEMENT, YOU MUST IMMEDIATELY CEASE ALL USE OF COSMOS LABS PRODUCTS AND DELETE ALL COPIES IN YOUR POSSESSION.
